These Comprehensive Terms and Conditions (“Terms,” “Agreement,” or “Policy”) constitute a legally binding agreement between you, the parent, legal guardian, student (where applicable, aged 18 or older), or user of the digital platforms, and KONOSIONI ARTS AND IDEAS PREPARATORY COMMUNITY SCHOOL, including its administrative personnel, faculty, staff, and authorized agents (“KONOSIONI,” “the School,” “we,” or “us”). KONOSIONI is defined as the educational institution operating at 320 S SPRING GARDEN SUITE E CMB 141, DELAND, FL 32720-5087, dedicated to providing preparatory, arts-integrated academic and community services as detailed in our Mission Statement. These Terms govern the entirety of the relationship, encompassing, but not limited to, the enrollment of a student, the payment of tuition and fees, the adherence to all academic and conduct policies, the use of School property, participation in School-sponsored activities, and the utilization of any School-provided digital resources, including websites, online learning management systems, and communication portals. It is imperative that all parties engaging with KONOSIONI carefully review and fully understand the extensive obligations, rights, and limitations outlined herein, as they establish the operational and legal framework for participation in our unique preparatory community.

1.2. Acknowledgment and Binding Acceptance

By submitting a formal application for admission, executing an enrollment contract, paying any fees or tuition, or utilizing any of the School’s proprietary digital services, you acknowledge that you have read, understood, and unreservedly agree to be bound by all provisions of these Terms and Conditions, including all referenced policies and codes of conduct, which are hereby incorporated by reference. Furthermore, by accepting these Terms on behalf of a minor student, you affirm that you are the custodial parent or legal guardian with full legal authority to enter into this contract and to bind the student to all relevant non-financial obligations, including adherence to academic standards and the Code of Student Conduct. Should you disagree with any portion of these Terms, your sole recourse is to refrain from enrollment, withdraw the student, cease payment, and discontinue the use of all School-provided services and property. This Agreement represents the entire understanding between the parties, superseding all prior or contemporaneous communications, proposals, or agreements, whether oral or written, related to the subject matter hereof.

1.3. Hierarchical Scope and Incorporation by Reference

These Terms are intended to be broad and inclusive. They specifically incorporate by reference the School’s official Student Handbook, the Code of Student Conduct, the official Privacy Policy (which governs data handling), the Financial Aid Policies, the Health and Safety Protocols, and the Acceptable Use Policy for Digital Technology. In the event of an irreconcilable conflict between the provisions of these general Terms and any specific, current policy document (e.g., a specific financial aid agreement), the terms of the more specific, contemporaneously dated document shall prevail only to the extent of the conflict. However, these Terms shall remain the overarching legal framework for the relationship. The School reserves the explicit right, at its sole discretion, to modify, amend, or update any section of these Terms or any incorporated policy at any time. Notice of material changes will be provided through official School communication channels (e.g., email notification or conspicuous posting on the official website), and continued enrollment or usage of School services after such notification shall constitute binding acceptance of the revised terms.

2. Institutional and Enrollment Terms of Status

2.1. Admission, Status, and Continued Enrollment

Admission to KONOSIONI ARTS AND IDEAS PREPARATORY COMMUNITY SCHOOL is granted based on the School’s holistic evaluation of the applicant’s academic readiness, creative potential, alignment with our integrated educational philosophy, and the family’s capacity to partner effectively with the institution. Admission is not guaranteed, and the School reserves the absolute right to accept or deny any applicant without explanation. The student’s enrollment status, once accepted, is valid for the duration of the defined academic year, subject at all times to the student’s continuous compliance with the Code of Student Conduct, the payment of all financial obligations, and the maintenance of satisfactory academic and behavioral progress as determined solely by the faculty and Head of School. Continued enrollment beyond the current academic year is contingent upon a formal, annual re-enrollment process, which requires the family to reaffirm acceptance of the current Terms and Conditions and meet all academic and financial requirements established by the School for re-admission. The School reserves the right, at its sole discretion, to decline re-enrollment for any student whose academic or behavioral performance is deemed detrimental to the educational environment or whose family’s participation is found to be non-supportive of the School’s mission and community standards.

2.2. Student Withdrawal and Financial Obligation

This section details the irrevocable financial consequences associated with a student’s voluntary withdrawal from the School. Upon signing the annual enrollment contract, the Parent/Guardian enters into an agreement to pay the full tuition and fees for the entire academic year, regardless of non-attendance, subsequent withdrawal, or dismissal. This financial obligation is incurred in consideration of the School setting aside a place for the student, thereby committing necessary resources, hiring faculty, and planning curriculum based on the projected enrollment. In the event of a voluntary withdrawal initiated by the Parent/Guardian: (a) If withdrawal occurs prior to the first day of instruction, a defined percentage (as specified in the accompanying Financial Agreement) of the total tuition remains due as a non-refundable, non-transferable withdrawal fee. (b) If withdrawal occurs after the first day of instruction, or at any time during the academic year, the Parent/Guardian remains legally obligated to pay 100% of the full, unadjusted annual tuition and all associated fees. No prorated refunds, tuition credits, or adjustments will be issued for any reason, including relocation, illness, or dissatisfaction with the educational services, unless otherwise explicitly stipulated in a written, signed agreement by the Head of School. This policy is essential to maintain the financial stability required to deliver our high-quality, integrated preparatory program and secure the specialized staffing necessary for our unique pedagogical model.

2.3. Institutional Dismissal and Termination of Enrollment

The School reserves the unilateral right to immediately dismiss and terminate the enrollment of any student, without refund or adjustment of tuition, if the student, or the Parent/Guardian acting on the student’s behalf, is found to have violated any term of this Agreement or the incorporated School policies. Grounds for immediate dismissal include, but are not limited to: (a) a severe or persistent violation of the Code of Student Conduct; (b) failure to meet the minimum standards of academic or behavioral performance after intervention measures have been exhausted; (c) material misrepresentation or omission during the admissions process; (d) failure to adhere to the tuition payment schedule (constituting a fundamental breach of contract); or (e) any behavior by the Parent/Guardian on or off campus that is deemed hostile, intimidating, defamatory, or materially non-supportive of the School’s faculty, administration, or mission, thereby compromising the integrity of the preparatory community environment. In the event of dismissal for cause, the Parent/Guardian remains fully liable for the balance of the full annual tuition, and the student will be immediately barred from attending classes or participating in any School activities.

3. Academic and Pedagogical Terms of Engagement

3.1. The Arts and Ideas Preparatory Curriculum and Methodology

The Parent/Guardian acknowledges and accepts that the core pedagogical model of KONOSIONI ARTS AND IDEAS PREPARATORY COMMUNITY SCHOOL is fundamentally rooted in an integrated, project-based curriculum that intentionally fuses core academic rigor (Mathematics, Science, Logic, and Humanities) with intensive artistic and creative exploration (Visual Arts, Drama, Music, and Design). The School’s commitment to “preparatory excellence” mandates that all students actively participate in this integrated methodology, which may differ significantly from traditional, single-discipline educational models. The Parent/Guardian expressly accepts that assessment of student progress will be holistic, incorporating traditional academic metrics (tests, essays, reports) alongside the evaluation of creative work portfolios, collaborative project outcomes, and demonstrated application of critical thinking and creative problem-solving skills, as determined by the faculty’s expert judgment. The School commits to delivering the integrated curriculum as generally described in its public materials but retains the sole discretion to make necessary adjustments to course content, teaching methodologies, assessment practices, and faculty assignments without prior notice to optimize student learning and respond to the evolving needs of the preparatory program.

3.2. Attendance, Participation, and Academic Integrity

Regular, punctual attendance is absolutely essential for successful navigation of the KONOSIONI integrated curriculum, given the reliance on collaborative, in-class project work and active participation in Socratic seminars and studio sessions. The Parent/Guardian agrees to ensure the student’s compliance with the School’s official attendance policy, as detailed in the Student Handbook. Excessive unexcused absences, chronic tardiness, or persistent patterns of non-participation in required integrated activities may lead to academic penalties, the inability to receive a passing grade, or, in severe cases, dismissal from the School. Furthermore, academic integrity is paramount: any instance of cheating, plagiarism, unauthorized collaboration, or intentional misrepresentation of intellectual or creative work will be subject to the immediate disciplinary actions outlined in the Code of Student Conduct, which may include suspension or irreversible dismissal from the School. This zero-tolerance policy upholds the ethical standards necessary for a credible preparatory environment.

3.3. Student Work Product and Intellectual Property

The Parent/Guardian acknowledges and agrees that all academic work, creative projects, portfolios, compositions, designs, dramatic works, and other intellectual property (collectively, “Student Work Product”) created by the student during enrollment at KONOSIONI using School resources, facilities, or as part of the integrated curriculum, shall be deemed the sole, non-exclusive property of the student. However, the Parent/Guardian grants the School a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, display, exhibit, publish, and distribute the Student Work Product for all legitimate non-commercial educational, promotional, and archival purposes, including but not limited to, display on the School’s website, inclusion in admissions materials, use in educational showcases (such as the Festival of Ideas), and inclusion in internal reports and historical archives, without any further compensation to the student or Parent/Guardian. The School shall use commercially reasonable efforts to attribute credit to the student creator when practicable.

4. Financial Terms and Payment Obligations

4.1. Tuition, Fees, and Payment Schedule

The Parent/Guardian is fully and irrevocably responsible for the timely payment of all tuition and non-tuition fees as established by the annual Financial Agreement, which is incorporated into these Terms. Tuition encompasses the cost of the core integrated academic and arts-based curriculum. Non-tuition fees may include, but are not limited to, enrollment deposits (non-refundable), technology fees, activity fees, materials and studio fees, field trip costs, and charges for optional programs such as before- and after-school care. The specific payment schedule (e.g., single lump sum, two installments, or monthly plan) must be selected and agreed upon in writing prior to the commencement of the academic year. Time is of the essence concerning all payments; any payment not received by the stipulated due date shall be considered delinquent and may incur a late payment penalty as specified in the Financial Agreement. Continued delinquency may result in the student’s temporary exclusion from classes, withholding of academic records, and ultimately, involuntary dismissal from the School, triggering the full financial obligation clause as detailed in Section 2.3.

4.2. Non-Refundability and Financial Aid Terms

All payments made to KONOSIONI ARTS AND IDEAS PREPARATORY COMMUNITY SCHOOL, including deposits, tuition, and fees, are, as a general principle, non-refundable, non-cancellable, and non-transferable, consistent with the annual contractual obligation for the full academic year. In the event of prolonged student illness, natural disaster, government closure mandates, or any unforeseen force majeure event that disrupts the regular on-campus instructional schedule, the School commits to utilizing all commercially reasonable efforts to transition instruction to a remote or digital format to continue the delivery of the preparatory curriculum. The Parent/Guardian expressly acknowledges that the School’s successful transition to an alternative delivery model, as determined by the Head of School, shall not relieve the Parent/Guardian of the full annual financial obligation, and no refunds or tuition adjustments will be made due to such necessary operational changes. If the student receives financial aid, the Parent/Guardian agrees that the aid is provisional and contingent upon the student and family maintaining full compliance with all behavioral, academic, and community conduct standards; the cessation of such compliance may result in the immediate revocation of the financial aid award.

4.3. Tuition Default and Collection Procedures

In the event of a material breach of the financial agreement, defined as any unpaid balance remaining 30 days past the scheduled due date, the Parent/Guardian shall be considered in tuition default. The School reserves the right to pursue all lawful means to recover the outstanding balance, which shall include, but not be limited to, initiating legal action to collect the full, unpaid balance of the annual tuition obligation, referral to a third-party collections agency, and charging the Parent/Guardian for all associated costs incurred by the School, including reasonable attorneys’ fees, court costs, and collection agency commissions. Furthermore, the School will withhold the student’s academic transcripts, diplomas, and official records until the full outstanding balance, including all accrued late fees and collection costs, has been remitted in full. This policy is necessary to ensure the continuous, high-quality operation of the integrated preparatory program and maintain the fiscal integrity of the institution.

5. Conduct, Health, and Community Standards

5.1. Code of Student and Parent/Guardian Conduct

All students and Parent/Guardians are required to strictly adhere to the standards of behavior, ethical conduct, and respectful engagement detailed in the School’s official Code of Student Conduct and the Parent/Guardian Code of Conduct, respectively. The Student Code mandates adherence to rules concerning safety, property respect, personal integrity, and respectful interaction with peers and faculty, emphasizing the restorative and educational approach to discipline led by our Wellness Coordinator. The Parent/Guardian Code mandates constructive communication, respectful treatment of all School personnel and volunteers, adherence to the spirit of collaboration, and an absolute prohibition on behaviors deemed hostile, harassing, intimidating, or defamatory towards any member of the School community, whether in person, via email, or on social media platforms. Any documented violation of the Parent/Guardian Code of Conduct that disrupts the educational mission or compromises the integrity of the community may constitute grounds for involuntary student dismissal, as detailed in Section 2.3.

5.2. Health, Safety, and Emergency Authorization

The Parent/Guardian authorizes KONOSIONI staff to act in a custodial and in loco parentis capacity with respect to the student’s safety while the student is participating in any School-sponsored activity, including off-campus field trips related to the integrated curriculum. In the event of a medical emergency requiring immediate attention, and if the Parent/Guardian or emergency contacts cannot be reached promptly, the Parent/Guardian grants explicit, irrevocable permission to the School’s personnel to seek, authorize, and administer all necessary emergency medical treatment, hospitalization, or surgical procedures deemed necessary by licensed medical professionals. The Parent/Guardian assumes full and sole responsibility for all costs associated with such emergency care and agrees to indemnify and hold the School harmless from any liability arising out of the provision of emergency medical services rendered under this authority.

5.3. Searches, Surveillance, and Drug/Weapon Policy

To maintain a secure and safe preparatory environment conducive to learning, all student lockers, desks, bags, and School-provided electronic devices are considered the property of KONOSIONI ARTS AND IDEAS PREPARATORY COMMUNITY SCHOOL and are subject to search at any time, with or without individualized suspicion, by authorized School officials. Any contraband, illegal substances, unauthorized weapons, or unauthorized technology found is subject to confiscation, and the incident will be subject to the full disciplinary process, including mandatory reporting to law enforcement authorities where legally required, and immediate dismissal from the School. Furthermore, the Parent/Guardian acknowledges and consents to the use of video surveillance technology on School property, excluding private areas, for the purposes of security, safety monitoring, and the investigation of breaches of the Code of Conduct.

6. Digital Use, Intellectual Property, and Media Policy

6.1. Acceptable Use of Digital Technology and Systems

The Parent/Guardian and student agree to adhere strictly to the KONOSIONI Acceptable Use Policy (AUP) for all School-provided and personal digital devices used on campus or accessing the School’s network or proprietary digital platforms (e.g., the LMS or communication portals). The AUP prohibits, without limitation: unauthorized access to data, transmission of copyrighted or illegal material, distribution of malicious software (malware), harassment, bullying via digital means (cyberbullying), and any activity that compromises the security or integrity of the School’s network. The Parent/Guardian acknowledges that the School reserves the right to monitor, inspect, and filter all data, communications, and internet usage occurring on the School network or devices for compliance with the AUP, and that the School is not responsible for the content of third-party websites or services accessed by the student. Violation of the AUP may result in the immediate revocation of network access, disciplinary action, or dismissal.

6.2. Intellectual Property and Commercial Use Prohibition

All content, trademarks, service marks, logos, designs, proprietary methodologies, curriculum documents, website code, and administrative materials (collectively, “School IP”) created, owned, or used by KONOSIONI ARTS AND IDEAS PREPARATORY COMMUNITY SCHOOL are the exclusive intellectual property of the School, protected by copyright and trademark laws. No Parent/Guardian, student, or user may use, copy, reproduce, distribute, or modify any School IP without the express prior written consent of the Head of School. Furthermore, the Parent/Guardian and student are strictly prohibited from utilizing their relationship with the School, the School’s name, or any School IP for any independent commercial gain, solicitation, advertising, or political endorsement purposes. This prohibition extends to the unauthorized dissemination or sale of instructional materials, test content, or proprietary pedagogical methods.

6.3. Media, Publicity, and Image Release

The Parent/Guardian grants KONOSIONI ARTS AND IDEAS PREPARATORY COMMUNITY SCHOOL, and its authorized agents, the perpetual, irrevocable, worldwide, royalty-free right and license to photograph, videotape, audio record, and otherwise capture the student’s image, likeness, voice, and name, and to use, reproduce, publish, display, and distribute these media items in any and all formats, including print and digital media, for the sole purposes of promoting the School’s mission, showcasing its integrated curriculum, recognizing student achievements, fundraising, and internal archival documentation, without further notice or compensation. This release is granted in recognition of the School’s reliance on media to effectively communicate its unique preparatory model and success to the community. Should the Parent/Guardian wish to opt-out of this general media release, they must submit a formal, written non-consent request to the Head of School at the beginning of each academic year, in which case the School will take all commercially reasonable steps to prevent the public use of the student’s image in future publications, though this cannot guarantee the removal of images already published or the control of images captured by third parties at public events.

7. Limitation of Liability and Indemnification

7.1. Assumption of Risk and Waiver of Claims

The Parent/Guardian acknowledges that participation in educational and extracurricular activities, particularly those related to our arts-integrated program, such as studio work, physical education, science lab projects, and off-campus field trips, inherently involves certain unavoidable risks of injury, property damage, or loss. By enrolling the student at KONOSIONI ARTS AND IDEAS PREPARATORY COMMUNITY SCHOOL, the Parent/Guardian knowingly and voluntarily assumes all such risks associated with the student’s participation in all School-sponsored activities, both on and off campus. To the maximum extent permitted by applicable law, the Parent/Guardian, on behalf of themselves and the student, hereby releases, discharges, and forever holds harmless KONOSIONI ARTS AND IDEAS PREPARATORY COMMUNITY SCHOOL, its Trustees, officers, employees, and agents (collectively, the “Released Parties”) from any and all claims, demands, liabilities, and causes of action for any injury, illness, loss, or damage, including but not limited to, property damage, personal injury, or death, arising out of or in connection with the student’s attendance at or participation in School activities, unless such injury or damage is directly and solely caused by the gross negligence or willful misconduct of the Released Parties.

7.2. Limitation of School’s Liability

In no event shall KONOSIONI ARTS AND IDEAS PREPARATORY COMMUNITY SCHOOL or the Released Parties be liable to the Parent/Guardian or any third party for any indirect, incidental, special, punitive, or consequential damages whatsoever, including damages for lost profits, lost data, loss of goodwill, or business interruption, arising out of or related to these Terms, the student’s enrollment, or the use or inability to use the School’s digital platforms or services, regardless of the legal theory (contract, tort, negligence, or otherwise), even if the School has been advised of the possibility of such damages. The School provides its integrated educational services on an “as is” and “as available” basis without warranties of any kind, whether express or implied. Notwithstanding any other provision herein, the School’s maximum cumulative liability to the Parent/Guardian for any claim arising out of or relating to these Terms or the enrollment of the student, regardless of the form of action, shall be strictly limited to the total amount of tuition and fees actually paid by the Parent/Guardian to the School for the academic year in which the event giving rise to the claim occurred, and this shall be the Parent/Guardian’s sole and exclusive remedy.

7.3. Indemnification Obligation

The Parent/Guardian agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees and costs) arising out of or in any way connected with: (a) any breach by the Parent/Guardian or the student of any covenant, representation, or warranty contained in these Terms or any incorporated School policy; (b) any act or omission of the student on or off School premises that results in injury, loss, or damage to any third party or School property; (c) the Parent/Guardian’s failure to pay any tuition, fees, or costs required under the Financial Agreement; or (d) any third-party claim alleging that the student’s creative work (Student Work Product) infringes upon the intellectual property rights or proprietary interests of that third party, thus obligating the Parent/Guardian to shield the School from litigation and costs stemming from their actions or failures to act.

8. Governing Law and Dispute Resolution

8.1. Exclusive Governing Law

These Terms and Conditions, the rights and obligations of the parties hereunder, and any claim or dispute arising out of or relating to the enrollment, the integrated educational services provided, or the financial relationship, shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. The Parent/Guardian and the School irrevocably agree that the exclusive jurisdiction for any legal action or proceeding arising out of or relating to this Agreement shall be the state or federal courts located in Volusia County, Florida. The Parent/Guardian hereby consents to the personal jurisdiction of such courts and waives any objection based on forum non conveniens.

8.2. Mandatory Binding Mediation

Prior to the initiation of any formal legal action or litigation (with the sole exception of collection actions by the School for tuition default), the Parent/Guardian and the School agree to participate in mandatory, non-binding mediation in Volusia County, Florida, conducted by a mutually agreed-upon neutral mediator. The purpose of this mandatory mediation is to attempt, in good faith, to resolve the dispute amicably and confidentially, reflecting the School’s commitment to restorative and collaborative problem-solving within its community. All costs associated with the mediator’s fees shall be split equally between the Parent/Guardian and the School. No litigation related to the dispute may commence until the mediation process has been completed or terminated by the mediator.

9. Miscellaneous Provisions and Contact

9.1. Severability and Non-Waiver

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed from this Agreement, and the remaining provisions shall continue in full force and effect. The failure of KONOSIONI ARTS AND IDEAS PREPARATORY COMMUNITY SCHOOL to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision in the future, nor shall it affect the validity of the remainder of this Agreement. Any waiver of a provision must be in writing and signed by an authorized officer of the School.

9.2. Entire Agreement and Survival

This document, together with all specifically incorporated policies (Student Handbook, Financial Agreement, Privacy Policy, etc.), constitutes the entire agreement between the Parent/Guardian and the School regarding the subject matter herein. Provisions related to financial obligation, intellectual property rights, indemnification, liability limitations, and dispute resolution shall survive the termination of the student’s enrollment, the withdrawal of the student, or the natural expiration of the academic term.

9.3. Formal Contact and Notice

All formal legal notices or correspondence required under these Terms must be sent in writing via certified mail or reputable overnight courier to the School’s physical address. Routine communications can be made via email to the primary administrative address.
